Terms of Service
These terms govern your use of The Reserv. They are written in plain English on purpose. Using the app means you've read and agreed to them.
Eligibility
You must be 18 or older to use The Reserv. By creating an account you confirm that you are at least 18, that the information you provide about yourself is accurate, and that you are not legally prohibited from using a service like this where you live.
Your account
You are responsible for keeping your sign-in credentials secure. Don't share your account, don't impersonate someone else, and don't create more than one account per person.
Community standards
The Reserv exists to help people meet at a real table for a real meal. Conduct that undermines that — on the app or at the dinner you arranged through it — is grounds for removal. Specifically, you agree not to:
- harass, threaten, intimidate, or stalk any other user;
- post nudity, sexually explicit content, hate speech, or content that targets or sexualises a minor;
- impersonate another person, business, or fictional persona;
- use the app for commercial solicitation, escorting, sex work, off-platform monetisation, recruitment, or networking unrelated to dating;
- post fake or misleading photos, false locations, or false biographical claims;
- attempt to obtain another user's contact information, address, or personal details under false pretenses;
- violate any applicable law in connection with your use of the app or any plan arranged through it;
- attempt to probe, scrape, decompile, or interfere with the service or with other users' accounts.
Plans and reservations
The Reserv helps you and another user agree on a restaurant and a time. The actual reservation is yours to book and yours to honor. We are not the restaurant, we don't guarantee availability, and we don't broker the meal. If you can't make a plan, cancel or pass on the request inside the app so the other person isn't left waiting.
Off-app behavior
We can only do so much to keep you safe at a dinner you arranged through the app. Use the same judgment you would for any first date with someone you met online: meet in a public place, share your plans with a friend, trust your instincts, and leave if something feels off. The Reserv does not background-check users.
Reporting and enforcement
If you see or experience behavior that violates these terms, report the user from their profile. Reporting also blocks the person by default. Egregious violations result in account removal, and we may share information with law enforcement when required by law or when we believe doing so is necessary to prevent harm.
Content you post
You keep ownership of your photos, profile, and plan content. By posting them on The Reserv you grant us a non-exclusive, worldwide, royalty-free license to host, display, and transmit them solely so the app can function — for example, to show your profile to compatible users or to deliver your chat messages to confirmed plan participants. The license ends when you delete the content from your account.
Service availability
We may change, pause, or discontinue features. We may also suspend or remove accounts that violate these terms or that we reasonably believe pose a risk to other users. We aim to keep the service running but we do not guarantee uninterrupted availability.
Termination
You can delete your account at any time from Profile → Delete my account. We may terminate your account if you violate these terms, if your conduct on or off the platform endangers other users, or if we are required to do so by law. Termination removes your access; the data-deletion behavior described in the Privacy Policy applies.
Disclaimers
The Reserv is provided "as is." To the fullest extent permitted by law, we disclaim all warranties (express, implied, and statutory), including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any user you meet on the app is who they claim to be, that any plan will proceed as planned, or that the service will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, neither The Reserv nor Marc Smith (the operator) will be liable for indirect, incidental, consequential, special, or punitive damages, including damages arising out of or relating to your use of the app or any plan, meeting, or interaction arranged through it. Our total liability for any claim related to the app is limited to the greater of US$50 or the amount you paid us in the twelve months before the claim arose.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these terms will be brought in the state or federal courts located in Travis County, Texas, and you and we consent to that jurisdiction.
Changes
We may update these terms. If we change them in a way that meaningfully affects your rights, we'll update the effective date below and let active users know in the app before the change takes effect. Continued use after the change takes effect counts as acceptance.
